Here is a message from our Settlement Fund Claim Administrator Gary

To Whom It May Concern:

This will provide current information regarding the Fallbrook/Erwin Eldercare Development Litigation Settlement Fund Claim Process.

  • This informational email is being sent to more than 250 recipients whose email addresses the Claim Administrator has compiled from available resources, but this email list does not define the only eligible claimants. Inclusion on this email list is intended as a convenience only.
  • The Claim Procedure Notice is the official communication being sent to the entire pool of eligible claimants, who were identified by the Claim Administrator based on a review of relevant documentation, historical data and property records, most of which did not provide email addresses.
  • The Claim Procedure Notice will be mailed to more than 1,500 eligible claimants consisting of property owners and residents in the greater Walnut Acres neighborhood and Walnut Acres Neighborhood Association members. Eligible properties are those roughly within the area bounded by Burbank Blvd. to the south, Manton Avenue/Le Sage Avenue to the west, Friar Street to the north and Sale Avenue to the east.
  • The Claim Procedure Notice will be mailed on or about Monday, April 23, 2018, and may be expected to arrive within 5 to 7 days via the United States Postal Service. It may also be distributed by email to those eligible claimants whose email addresses are available.
  • The Claim Procedure Notice contains information and instructions for those who wish to submit a claim.
    The deadline to submit a claim is June 30, 2018.
  • Depending on the number and nature of claims received and subject to extension, claimants may anticipate a final allocation and distribution of funds along with a final report and accounting within approximately 45 days after the final claim submission deadline.

A final comment: The Claim Administrator’s mission is an orderly, efficient, cost-effective claim process. The process has been, is and will continue to be independent, objective, fair, inclusive and transparent. Because the flow of information is process-driven, responding to most inquiries or assumptions is inimical to efficiency and cost-effectiveness, is unnecessary to maintain legitimate independence, objectivity or transparency, and will ultimately reduce the funds available for distribution to you and your neighbors. Consequently, the Claim Administrator has at times responded to emails only briefly or not at all. Such responses (or lack thereof) to individual inquiries, comments or communications may be considered the norm and will generally (and respectfully) continue.
